Oracle declares force majeure on a New Mexico Stargate site

Oracle sent a force majeure notice to financing partner Blue Owl Capital covering Project Jupiter, a planned 2.45-gigawatt data-centre campus in New Mexico built as part of the Stargate infrastructure programme with OpenAI. The notice does not withdraw Oracle as anchor tenant; it preserves Oracle’s right to delay payments should the facility miss its 2028 target for coming online.

The delay traces to a gas pipeline that Energy Transfer had planned to build to supply the site, intended to feed Bloom Energy fuel cells that would power the campus. Regulators repeatedly denied the pipeline’s permits, pushing its completion back nearly six months to February 2027, and the fuel-cell system separately faces a 23 November deadline to secure an air-quality permit from New Mexico’s environmental department. The project had already drawn scrutiny over water and air-quality concerns and become a point of contention ahead of the state’s midterm elections.

Oracle said the campus “remains on our planned schedule” and that the company was “fully committed to New Mexico and confident in our path forward”; Blue Owl said the force majeure notice “does not change the financial commitments to this multi-year project.” The episode was among the first public signs of permitting and infrastructure strain inside the Stargate build-out, which had otherwise proceeded through a string of groundbreakings, including OpenAI and Oracle’s Michigan campus opening in June, without comparable regulatory delay.
